Terms and conditions of Brüh. Kaffeewerk GmbH, Speditionstraße 17, 40221 Düsseldorf, Germany, for pickup pre-orders and for the sale of drink cards. The German version is the legally binding one.
Section 1 — Scope
These terms apply to every order placed through this website for collection in one of our shops, and to the purchase of ten-drink cards. We do not accept differing terms from a customer unless we have agreed to them expressly in text form.
A consumer is any natural person entering into a legal transaction for purposes that are predominantly outside their trade, business or profession.
Section 2 — Contracting party and conclusion of contract
The contract is concluded with Brüh. Kaffeewerk GmbH. Two of our shops are run by franchise partners; when you order in one of those shops we identify the operator as the contracting party before you complete the order.
The presentation of goods on this website is not a binding offer but an invitation to place an order. By submitting an order you make a binding offer. The contract is concluded when we accept the order in text form or make the goods available for collection.
This website is a demonstration build. The order flow deliberately ends at the review screen before payment; no order is sent to a shop and no contract is concluded.
Section 3 — Collection only
We do not deliver. Every order placed through this website is for collection in the shop you choose. Collection is at the end of the counter.
Section 4 — Prices and payment
All prices are final prices and include German VAT. The price is the same in all seven shops, whether you sit in or take away. Payment is by card, in the app, or in cash at the counter.
Section 5 — Collection time and uncollected orders
The wait time shown is an estimate made by the staff at the till and is not a binding promise of a completion time. We hold prepared drinks for up to 30 minutes after the stated completion time.
If a paid order is not collected, we may dispose of it once that period has passed. There is no right to a refund in that case where you are responsible for the failure to collect. If we were unable to provide an order for reasons within our responsibility, we refund the full amount.
Section 6 — The ten-drink card
The ten-drink card entitles the holder to ten drinks from the espresso bar in all seven shops. It is not issued to a named person, it does not expire and it may be passed on freely. Any remaining value cannot be paid out in cash. We cannot replace a lost paper card, because it carries no link to a person.
In the app version the balance is tied to the account and survives a change of device. If the account is deleted, unredeemed stamps are lost.
Section 7 — Allergens and product information
Information on allergens and additives is available in writing in every shop and is given verbally on request. Our kitchens and bars handle milk, gluten, egg, soy, sesame and nuts among other things, so cross-contamination cannot be excluded. If you have an allergy, please speak to us before ordering.
Section 8 — Warranty
Statutory rights in respect of defects apply. We take complaints about an order directly in the shop; alternatively you can reach us at hallo@brueh-kaffeewerk.de.
Section 9 — Liability
We are liable without limitation for intent and gross negligence and for injury to life, body or health. In cases of simple negligence we are liable only for breach of a material contractual obligation, that is an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely; in that case liability is limited to the foreseeable damage typical of this type of contract. Liability under the German Product Liability Act is unaffected.
Section 10 — Governing law and jurisdiction
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer protection provisions of your country of residence remain unaffected. For merchants, the place of jurisdiction is Düsseldorf.
Section 11 — Dispute resolution
The European Commission’s online dispute resolution platform is at ec.europa.eu/consumers/odr. We are neither willing nor obliged to take part in proceedings before a consumer arbitration board.
Section 12 — Final provisions
Should any provision of these terms be invalid, the validity of the remaining provisions is unaffected. The statutory rules take the place of the invalid provision. Last updated: 1 September 2026.
